The article deals with issues related to the activities of the investigator (inquirer) after the suspension of criminal proceedings. The author focuses on the importance of improving the legislation governing the specifics of the suspension of a criminal case. Based on the analysis of the judicial practice of the Supreme Court of the Russian Federation, takinginto account the position of the Constitutional Court of the Russian Federation, the article assesses the existing legal restrictions associated with the lack of the investigator, the interrogating officer of the necessary tools to resume criminal proceedings. Changes are proposed to the Code of Criminal Procedure of the Russian Federation, aimed at expanding the powers of the investigator (inquirer), regarding their procedural activity in suspended criminal cases.
