The article examines the problematic issues related to the establishment of the limits of necessary defense when protecting against encroachments that are not associated with life threatening violence. The author proposes to supplement Part 2 of Art. 37 of the Criminal Code of the Russian Federation with a provision in accordance with which a professional law enforcement officer will determine the legality of the harm caused by the defending person on the basis of the principles of proportionality and necessity. In addition, in order to establish a uniform judicial practice, it seems reasonable to introduce a number of additional provisions into the decision of the Plenum of the Supreme Court of the Russian Federation, which will guide the law enforcement officer when considering criminal cases related to causing harm when the limits of necessary defense are exceeded. The formulated proposals willallow not only to expand the opportunities for the defender by narrowing the scope of the excess of defense, but also to generally increase the efficiency of law enforcement.
