This article analyzes the individual elements of administrative and legal status of participants of administrative offence proceedings, who have an interest in the outcome of such a case. Particular emphasis is shifted to the person in respect of whom this type of proceedings is carried out. The features of the procedural rights and duties of this person are revealed, they indicate the need to amend the current provisions of the Code on administrative offences of the Russian Federation, designed to enshrine the mandatory compositions of administrative offences provided for in chapter 12 of the present Code; on them the participation of counsel will be mandatory in order to ensure his rights in the commission of administrative offences.
