The article is devoted to the consideration of objective factors that predetermined the development and adoption of the Soviet Decree on the Court No. 2. The author attempts to study the circumstances of its preparation, discussion and adoption through the prism of general socio-political processes, problems and trends inherent in the first days and weeks of the existence of the new Russian statehood. In addition, the author analyzes the circumstances of the preparation of the draft Decree, which took place in the conditions of violent controversy and fierce struggle between the Bolsheviks, who advocated the complete destruction of the former criminal justice system, and the left SRS, who intended to preserve the best traditions of Russian justice, taking into account their adaptation to new socio-political realities. At the same time, a brief description of the content of the Decree is given.
